I sent a cheque, she's saying she didnt recieve it. Anyone who has been kind enough to sell me kit on here knows I'm good at comms and pay up, I'm like that on e-bay too with 178 pos feedback, yet I found her to be totally uncooperative. I wondered if anyone else had any experience, or am I just unlucky? (and £35 down :( )

I am presuming that you mailed the cheque.

Because you say you're £35 down your post reads that the cheque has been banked.

Did you send a cheque with the payee named (ie, you didn't leave the payee space blank or make the cheque payable to cash)?

If you've named a payee then the bank can only process the cheque into an account in that name - if it does otherwise it can make itself liable.

The seller says the cheque wasn't received. If this is correct then the seller isn't being uncooperative as in fact there's nothing she can do from her side (if she didn't get it, what can she do about it?).

So, if you named a payee, if the cheque was banked, if your bank account has been debited BUT the seller is adamant that the cheque didn't arrive in the mail, then YOU need to contact YOUR bank and instruct them to investigate as a fraud seems to have taken place (ie, some other person intercepted the cheque and paid it into an account for which it wasn't intended). In such circumstances, the fraud is usually against the bank, not against you, and the onus is likely to be on the bank to reimburse you.

If the cheque failed to reach the seller then I would hazard that under Ebay terms the onus remains with you to settle the purchase unless you can come to some other arrangement. The hard truth is that you've entered into a contract to buy which needs to be fulfilled or cancelled by mutual agreement though the sensible way forward might be for the transaction to be suspended until the bank have established who recieved the money.

So, for what it's worth:

Contact you're bank and inform them that a cheque wasn't received by the intended party and has been debited to your account and so a fraud has occured. Confirm this to the bank in writing and if you have evidence (ie an email) from the seller confirming non-receipt then provide this to the bank. Request immediate reimbursement of your account. Inform the seller what is going on (so the seller can't imagine that you're trying to wriggle out of the purchase) and come to whatever arrangement is mutually acceptable to complete, suspend or cancel the transaction.

Not had a problem with suesue, i got replacement items after sending 1 email to say i hadnt received said items. Although postage out can sometimes be a little slow. :?

Only used them once, a while ago ........

Took ages to get the kit and that was only after numerous BS excuses.

Seems to be luck of the draw as most people seem to have no probs :roll:

Cobbaton Combat is a great place to visit. Loads of kit (mostly Brit) on display (could do with a dust though, LOL!). Have bought direct at the museum though not over the net - owners were decent chaps.

Yes, bonkers 'museum' (sheds with dusty relics as Woodlander says) miles down tiny Devon lanes - not sure how they got the tanks in!
There's a chunk of a Horsa there too but it's a film prop IIRC
Judging from their non-updated web site there must be loads of kit for sale hidden out of view - wish you could rummage like at Sabre. :lol:
