ah sorry mate, for some reason i thought suesue were HK based. that's a pisser.
Distance selling regs dictate that the seller has up to 30 days to deliver your goods.
Your contract is with them. Their contract is with Royal Mail.
If they haven't come up with the goods within 30 days they have failed to deliver their contract with you and HAVE to refund you in full. If the 28 days hasn't passed yet you don't have much of a legal leg to stand on.
If, however, you paid to get it delivered quicker they should honour that. They can't use the excuse of the Royal Mail because your contract is with SueSue, if it's gone missing they should resend and take up their claim through their contract with RM.

Of course if SueSue are selling as private individuals and not as a business then they aren't liable to comply with the regs. But then if they are turning over quite a bit of money you might find HMRC will be interested.
Sorry to hi-jack just thought I'd pipe up about that. Delete if you want Gadge.

id take a drive to their "place of busness"home or work, and talk to them "face to face", if theres no joy , hoof the door in and take what your owed

I've got an Oak Leaf Zelt you can use - its not splinter, but better than nothing if Sue Sue's still not come through.
Also, I've got a Flecktarn poncho which, while not quite period, is pretty similar to the old German camo.
I'll bring them both, so if you're stuck...

You could try contacting your local royal mail depot, one time I had an item go missing and when I went to the depot to collect a different package a few weeks later they produced two parcels one being the 'lost' item.

Ive been to the depot twice and have had them do manual searches of both glaisdale and beeston.

I am most annoyed that Sue sue seem to be compleltey uniterested and have jjuyst asked me twice to check with royal mail.
I've told them i've done everytihng i can, royal mail say they have no record of it and that normnally its the sellers respopnisbilioty to compensat.
i've explained to sue sue that the kit is neeeded for an event and that we recommend there services, still no answer.
i've given them til this evneing to respons or i open up an ebay dispute and claim the money back via paypal,
can anyone guide me as to how to do this?

gadge,
for ebay try - http://pages.ebay.co.uk/help/tp/using-dispute-console.html and/or http://pages.ebay.co.uk/help/tp/questions/protection-program.html
Once your logged into ebay using your logon you can get to the dispute section and raise a 'case'
I've not done this myself, as everything has come good for me.
Good luck tho and sorry to hear suesue has let you down

I`ve used the ebay dispute twice, I think mine were a case of the seller forgetting to post the item though. As far as I can gather, all ebay does is open up a pop up detailing the reasons for the dispute everytime the person logs on there, which in sue sue`s case would be quite often, this pop up won`t close until the dispute is settled, so it could get quite annoying for them and if nothing else, may get them to at least respond to you. I`d try the dispute route and keep pestering them as getting money back via paypal is apparently a right pain in the arrse. ![]()
raise the issue with paypal iu got my money back from a dispute paypal are fairly ruthless they jut take it back out of the users account, folowing thatfailing your credit card will refund you as although you paid with paypal you used a card. failing that threaten them with small claims court... i have always found suesue to be a bit slow but most reliable.
Ebay rules do state that it is the sellers responsibility to ensure safe delivery.
hope this helps....
