Anyway, to get back on topic, I was speaking to someone at AirsoftWorld and was told that the final draft for section 36 is out with copious notes containing guides to interpreting the new legislation, I've been trying to get a copy of these but have been unsuccessful, does anyone have a copy or know where to get one?
Some of the things I was told was that in the notes it is suggested that the definition of a skirmisher will be someone who attends an accredited site, (one with PLI), 3 times in 2 months, although this is only in the notes and therefore not a legal requirement that's probably going to be the criteria most sites will use, also with regard to the skirmishers database the intention is that you will have to re-qualify annually or your name will be removed from the database. I asked about the situation with regards to re-enactors and was told that a pukka group, (one with a proper constitution and the inevitable PLI), could register it's members in the same way as skirmish sites.
IIRC It's 3 times in no less than two months , ie you can't go Saturday Sunday & Monday and then demand a card / etc .
The reenacting route is easier as a defence...... the $64000 question is will UKARA accept reenactors as appropriate for their database and hence buy Airsoft guns? ....if so then the possiblilites are quite open ....especially to people who engage in WWII Reenacting Airsoft games.....

When I spoke about the skirmisher database I did mean the UKARA one, (I just couldn't remember the acronym), the guy I spoke to at Airsoftworld seemed to think that re-enactors would be accepted although that’s not a guarantee, but if you look at it from a commercial aspect are airsoft retailers likely to turn away customers who have a valid legal defence? I would be surprised if they did in view of the detrimental impact the VCRA is going to have on their businesses.
I really need to read all this more carefully as to be honest the whole thing confuses me greatly.

For example a agm mp40 is a dam sight cheaper than some non fucntional mp40 replicas and actually looks more realistic.

Think thats what guy is looking to get around, I know the blank firing side of things the reenacters need to be a member of a group ie not a solo gun totting fancy dress person, and airsofters will need some form of membership to a site (though I'm guessing this could work with a group) Its probs like most things down to affiliation if you can get it.

I think you'd be in the same boat as an acredited skirmisher in that you'd have to convince HM C&E that you qualified for a specific defence and as yet I've seen nothing about any mechanism that C&E are setting up to deal with this situation.
That said keep in mind that, (as far as I'm aware), the VCRA does not refer to airsoft guns it only refers to RIF's, (Realistic Imitation Firearms), which covers anything, airsoft, pfc, blank firing, inert models etc.,so if you have a defence you should be able to buy and import any of those types of RIF's, it's just a question of how you convince C&E that your defence is valid.
Two things to bear in mind
- the UKARA database that is being set up is there for the benefit of the retailers. It proves to the Authorities that they took reasonable steps to verify the purchaser. It is not there for the benefit of sites nor RIF purchasers (though the reality is that purchasers would find it difficult to buy without being on the database, so you could say it's a mutual benefit).
It looks like third parties will be able to use the database - forum access is being facilitated for example.
Secondly, as far as importing goes then there is nothing to stop you going ahead. To comply with the law you must be in one of the 'allowed' groups but there is no mechanism for proving that. So the HMRC will have to make further enquiries and either the old bill will come round and check you out or it might just be something a simple as a self-declaration as is currently done with velocity declarations. Well, one can hope.
So, to buy from most retailers you will need to be on their database as this is the evidence they ask for. Other retailers will have their own criteria - airsoft shops for example should have all the evidence they need anyway.
To sell your second-hand kit to another party you need to make absolutely sure of their validity (it's you the seller that is causing the offence).
To import or manufacture you need to have documentary evidence that you fulfil the defence criteria, should you be required to prove it.
CiA are on the case to work within the letter and spirit of the law to find a solution that makes life easier for all parties concerned. I'd venture to say that in the short term things might be a bit tricky but meh, you've all gone out and bought all your RIFs anyway, should do you for a while!
Just a thought, some sites have membership schemes in place, will these be backdated or will the registration start on October 1st.
If the latter is the case then UK retailers are going to have a fairly lean time selling complete AEGs for a couple of months which could hit them hard.
On another note the chap who ran the local site down here has just shut it down because of all this nonsense, he sold kit as well and couldn`t be bothered with the red tape he faced.
As he has a place in Brittany he did think about starting a site over there instead.
I don`t go to open days any more, in fact I`m lucky if I get out twice a year to airsoft so I don`t think I`ll be enrolling on any membership scheme. At the moment I`ve got an MP40 and an old AK I can strip for internals if necessary. Tomorrow I`m hoping to pick up a 2nd hand MP001 to convert to a K98 with one of Warrens kits when funds allow. Hopefully this lot will keep me going for a few years.
To be honest, this forum is the only reason I still have any kind of interest in airsoft. Having had my handgun taken from me a few years ago I thought I would be safe with guns which fired bits of plastic.
I did make a joke to my Mrs when I took up airsoft back in 2003 about giving it a couple of years and the powers that be would put the kybosh on another one of my hobbies, how we laughed when I first heard about the VCR bill.
